- ReD makes no warranty or representation regarding the results that may be obtained through use of the Service including accuracy or reliability of retailer's information pages (products/services) nor any goods or services of retailers from whom gift vouchers may be purchased, nor any transactions entered through an ReD web-site, nor in relation to any expectation of level of service by you, such as uninterrupted, timely, secure or error free systems. ReD will not be held liable for any DIRECT, Indirect or Incidental, special or consequential damages of any kind, which may result from your use of the web-site services.
- You agree to indemnify, defend and hold harmless ReD, its affiliates, officers, directors, employees, consultants and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of ReD's services, your violation of the Terms of Service or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity.
- To the extent permitted by law, ReD's liability under any condition or warranty that cannot be legally excluded is limited exclusively, at ReD's option, to product or service replacement or the replacement or the refund of purchase price.
- ReD reserves the right to terminate any Member account, Corporate account, Affiliate account, Retailer account or Reminder Service Registration account if ReD learns that the account has been set up using false or misleading registration information or has violated the Terms of Service.
- ReD may modify or discontinue its services or any account with or without notice to you, without liability to any user or any third party.
- You are responsible for maintaining the confidentiality of your account number and / or password (where applicable). You are responsible for all uses of your account, whether or not authorised by you. You agree to immediately notify ReD of any unauthorised use of your account.
- The Terms of Service will be governed by and construed in accordance with the laws of the Australia, without giving effect to its conflict of laws provisions or your actual state or country of residence.
- The Terms of Service will inure to the benefit of ReD's successors, assigns and licensees.
- Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by ReD.
- If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.
- The Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
Additional Terms of Service for Personalised Services
- You agree that ReD will have no liability for loss of personalisation settings or for serving a personalised service to a user other than you, the user who registered the personalised service.
